Property of orphaned woman after her death

An orphaned woman who lived near my house and my mother was taking care of her life till death (almost 20 years). She died at the age of 82. While alive She nominated my mother in all his bank account was also taken care by my mother. She died in 2003. My mother and my family did this as service, so we din't care about her property ( only one House). We understand that the house should go to government. But suddenly At 2006 A new person (Who is no relationship with the old women) from next village suddenly took all the house documents and sold the house to Neighbor. He utilities the local guys signature during registration. In the absence on "any" to whom the house belongs to. Kindly advice how to proceed and bring the property to government

Verify at the Sub-Registrar's Office whether the property in question was sold. You may apply for Encumbrance Certificate covering the relevant period during which you suspect the sale was registered. If the fact of sale is reflected in the EC, obtain a certified copy of the registered sale deed from the SRO. With all the documentary evidence on hand, appeal to the District Collector for taking necessary action.

Only way is to approach civil court with all documentary proof...Send legal notice to both parties and start proceedings. Kindly check in whose name the land tax and house tax is paid so far...Also apply for encumbrance certificate and possession certificate..

Any unclaimed property will be taken over by the government through revenue authorities,by adopting certain procedures.i assume that some third persons grabbed the land by immpersonisation and by forged documents.you can very well lodge a criminal complaint under land grabbing act, with the jurisdictional police and also revenue authorities
