property issue between sister and brother
31-Oct-2024 (In Property Law)
My Husband father's (my father in law) land (self property not ancestral), but he didn't do any will before his death and now that property is in mother in law's name (his wife), now his daughter want to get his property but after marriage my mother in law had given money to her instead of property but now she is asking her father property also so what can we do to sustain our land
if he is just asking for a share in the property left to behind by her father it would be difficult for you to argue Katha Har mother had given sufficient money to her instead of property, as it does not become a partition after father's property. but she cannot claim whole land nor her mother can give so.
firstly You will have to provide all the relevant documents like title deed, sale deed, mother deed, tax paid receipts and Katha etc.,
If it is your husband father's property and he died without any will, all the legal heirs will get equal share. even if the Katha is in the mother name all other legal heirs will get equal rights.
coming to his sister's part if she has already taken money she have to execute the release deed in favour of the other legal heirs
