Property Issue and want best legal suggestion

My grandfather has a will, after his death my father will get the property paper still we dont have any property paper but my father has been living for approx 30 years of that property and we have all the bills with the name of my father, and we are 2 brothers i am the elder but my younger brother have got married with a already married characterless women and one daughter and now my father dont want to give anything to him so plz suggest me the best or legal way for the above 2 issues

Hi first of all U can tell the court about the current suitation and all u can also tell the court that that according to the will the property which is of your father Wants to give it to u only not his younger son and tell the court that how the younger son is not capable of being s part of the propert and all because of his demands and al

There is no concept of disowning a son in Indian legal system. It is immaterial, whether a father wants to or not, he has to maintain his child until he reaches the age of majority. With respect to the property law, a son may be disinherited from the self acquired property of the father, but he will still have equal rights as the father over the ancestral or the coparcenary property of the Hindu Undivided Family. In your case your father can get the notice published in two local newspapers that he is severing his ties with his son and disowing him from his movable and immovable properties.
