29-Jul-2023 (In Property Law)
We have 20 acres of land. It is in my grand paz name , he is no more . The paani now is in my dad’s name , he passed away two years back. My dads sister have claimed for that property. My grand ma have written will that her share shud go to her daughter and grandma is no more. 20 acres land is the only source of income for my mom. Can I challenge the Will written by my grandma ?? Will we get share in that?

A family member can challenge a will on the grounds that they were not provided for adequately in the will. The law states that the head of a family is responsible for the proper maintenance of certain close family members who are specified in the Hindu Succession Act. If a proper provision is not made for these people in the will, or they are not adequately provided for the laws of intestacy, they can make a claim in the Family Court or High Court asking for provision to be made for them out of the estate.

Can you provide this with more clarity? I understand that the land was in the name of your grandfather, after that your father's name was entered in RTC pahani ,and continues to be so even now. in this situation how your grandmother can write a will when the property is not in her name ?
