As soon as a civil suit is filed it is filed along with an application for stay under Order 39 Rule 1 and 2 of CPC . Then first there will be argument for stay and normally stay is granted in the first hearing itself till further orders. It depends upon the advocate ,normally it takes 2 -3days as soon documents are handed over to the advocate to file a case. I come to Indore to appear I cases in civil, criminal in district and High court ,can contact me .

As soon as the claim is prepared by the lawyer, it is filed, along with application for taking stay is also made, there is no fixed time limit for this, this work can be done in 1 month, 2 months or even 4 months.
