Procedure to waive off right over father's self owned properties
14-Oct-2023 (In Property Law)
Hi, My father has self owned properties in the name of my dad and mom. Also he has a property from my grandfather. I have a younger sister. I am unmarried yet and not interested in any of his or my grandfather's properties for me or for my future husband or my in-law's family. So what is the procedure to be followed to make a legal statement saying that "Me or my husband or my in-law's family has no right in my parents properties either now or in the future, even if my parents wish to transfer the properties in our name". Also is it required that my future husband and his family should sign in this statement? Does this agreement create a proof that, me or my in-law family has a right over these properties? Because my dad said that this will create a proof of right and he suggested dont do this. Please help me to resolve this and share me the procedure for this process. Thank you in advance
I am really happy to hear that you don't need your father's property. Since the property is a self acquired property of your father, a simpler way to waive off your right in property is to ask your father to settle his existing property to his other daughter and you can be the witness to the said document. By doing so you can waive your rights
What I understand from your query is that you are not interested to acquire your Dad's property or inherited property from your grand father as well. Likewise your future husband and your future in-laws also not interested. ..If that is the case, you need not to create any statement or documents. As per Hindu succession, your husband or his parents will not have any right of your fathers property. Your query is clear in some points. Feel free to contact me if you need a detail opinion regarding this.
