You need to apply for heirship certificate to civil court where the property is situated. It will be helfpul even in case if your father had mortgaged the flat,as bank will seek for heirship certificate for handing over title documents.

Hello,

You simply need to make an Application before the Society in which the flat is along with a copy of the Death Certificate stating that your Father has expired and your Mother is the Legal Heir and therefore her name be mutated and the Title be transferred in her name. The Society shall do the needful.
