Procedure to purchase share of sibling originally is mother's name.

Hi, We have a house which was originally in my mother's name. Mother filed K-Form in co-op housing society to nominate her two sons. Co-op housing society has transfered share certificate in two son's name accordingly. My sibling used to stay there but not any more. My Father is still staying there. I am staying in other city. Now, I want to get my share of the property and provided two options to my sibling -- either buy my share of the property or sell his share of the property. My questions are as follows, 1. What IF my sibling says he does not want to sell his share of the property? Can I get a legal support to force him to sell his share or buy my share? 2. What IF he just moves in to the house and stay there forever denying me of benefits from the proceeds of my share. Can my sibling be legally obliged to stay out of the house so as to motivate him to sell his stake or buy my stake? 3. I have paid all money in extending upper floors of the house etc. Can i claim it?

As per your question
1) This is your family matter you can settle within your family. Now you can not legal right to force him to sell his share or buy your share.
2)If you want to sell your share to the third person than he have to leave your share.
3)As per your 3rd question you have to claim your or to prove that you have paid all money for extending upper floors of the house.

In Joint Property both the parties have equal rights and no other party can force other for anything. Only you can take possession of the property as far as your part is concerned through court. That will involve a court matter.
