Procedure to get property transferred in my name after fathers death

My father died a few years back and I want the property to be transferred to my name, my brother is not cooperating,but my mother is willing to transfer to my name.How to go about it. We are Indian Christians.

After your fathers death all the legal heirs of your father are became co-owners of his property. your mother can release only her share in the property but if your brother is not willing then you cannot obtain full ownership. your brother is entitled for the part ion of the property.

As an Indian christian you are governed by the Indian succession Act 1925 .If your father has no left a will then 1/3 rd of the property will go to your mother and the remaining 2/3 has to be divided between you and your brother.

It is better to talk with each other and hammer out a solution. Going to court to get things done should be the last option.. In case if your brother refused to budge then consult a lawyer with the documents including death certificate of your father and legal heir ship certificate. The lawyer will take care.
