Procedure in case aunt purchased land but owner did not register it

Sir, My aunty purchased 20 guntas agriculture land from one person & full sale consideration Rs 45000/- was paid to the vendee before witness & vendee executed a sale agreement on Rs100/- non judicial bond paper &signed before witness in the year 2006.But vendee post poned registration saying the land was not mutated in his name & patta pass book was not issued in his name.Vendee taken additional Rs1000/- from my aunty for obtaining mutation proceeding from Tahsildar,vendee said that after getting proceeding in his name, he will register the land on my auntys name.But till 10 days back vendee said proceeding was not issued in his name.We are enquired about the land on revenue offic &we found the land was got mutated on vendees name.We have taken meeseva pahani & produced before vendee.Then vendee refused for registration on my auntys name & denied the sale agreement & shouted on my aunty.Now vendee plans to sale the same land to others.What are the remedies vendor got againest vendee.

A suit for specific performance to be filed against the said person who has agreed to sell by executing the agreement of sale and now denying to come forward to execute sale deed. You have to pay court fee and show your readiness for exection of getting sale deed in your favour. You can also file criminal case for breach of trust for keeping your aunt in dark. You can send a legal notice giving appropriate time to execute the sale deed in favour of your aunt, after completion of notice period you can file a civil case in the jurisdictional court of law for execution.
