Procedure for collecting Pooja and Function Funds in CHS

15-Apr-2023 (In Property Law)
We are a Co-operative Housing Society. I'am from working committee .Recently there was a news that funds for pooja and cultural activities has to be collected and accounted for separately and not mixed with the regular maintenance fund of the society. Hence working committee has decided to collect additional funds separately every month from all members for the annual pooja and cultural activities. Our query is whether we have to call for a special general meeting of all members formally (like the AGM) following all the usual rules or a informal meeting of all members is enough for this purpose. (2) Whether the decision can be taken by WC and later ratified by AGM.(3) Whether the decision taken by AGM/WC is binding on all members as there is a doubt that pooja and functions are outside the purview of chs. Awaiting an early reply on all three related queries. Thanks and Regards Prasad.G

This is my response to you:
1. You must collect funds separately;
2. An special agm can be called for such activities;
3. You will need to state more facts of your case;
4. Consult a local lawyer and take steps.
