Power of Attorney in Delhi in case of no blood relation

01-Jul-2023 (In Property Law)
My father was a power attorney on behalf of his sworn sister (no blood relation) and was defending a suit for possession of the property since 1999 now the appeal is in the Hon'ble Delhi High Court. Last year in 2022, I lost my father to Covid. nnI want to know whether my father's sworn sister can execute the Power of Attorney in my name? As it is clear that I am not related to her by blood will that be an issue? nnIf the answer is yes and she can execute the PoA in my favour, even if she has her son present but she is not willing to give him the authority? nnCould also provide me with the legal reasoning/basis behind your answer? nnfor me, knowing the legal reasoning is important because I have been told by an advocate that in Delhi now the PoA can only be given to a blood relative due to some changes in rules made somewhere after 2010. Is that correct?nnThank you

to contest the case you can authorize any person who is familiar with the case and that person can proceed with the case .... I am dealing with one similar case in which there is no blood relation....there is no embargo to file poa without blood relation

Hi
A POA cab be issued irrespective of blood relations. The difference lies on the stamp duty applicable. Will need to understand your case in detail to guide you further. Please feel free to get in touch for further discussions.
