Possession of house for 50 years can I sell it

07-Jun-2023 (In Property Law)
We have been living in a house for more than 50 years. We are regularly paying property tax to the municipality. But we don't have proper documents to claim the ownership of the house. Now we are in need of money. How do we proceed to sell the house?

In the absence of title documents, you can claim property through various means. In fact, if you intend to sell it, the same can be done by a proper conveyance deed. We can assist you in obtaining a proper title to the property to enable you to do what you want. Give the property particulars to advise further.

Hi
Technically if you have been in possession of property for 50 continuous years and paying taxes to municipality, electricity bills and having water connection (assuming these taxes are in the name of elders/yourself), then you are the owner of the proper.
50 years ago, people were simple and honest and hence documentation was bear minimum.
however as we have evolved, people also have become cunning and dishonest.
Also law has evolved.
though you might not have any problem in selling the property, it is good to consult a lawyer with all documents you have so that if there is any lacunae( missing documents) the same can be rectified and you can get a higher sale value.
hope this helps.
