Partition suit filed by my elder brother civil court 2005

My father retd. Executive member KIADB . WE ARE 2 ELDER Sisters(aged 63 and 62 years) and 1 elder brother (aged 60years) and me last(aged 55years). My father died in 1994 inestate my mother in 2001. My father made many properties in my brother name factory and agricultural lands at his age 21 years and since I was a minor and studying. After my father death my brother said all properties belongs to him and partitioned to his children and filed a partition suit wanting to grab some leftover ancestoral agricultural lands. I have filed a counterclaim sum total of all the properties since my died inestate in 2005, I am a defendent in partition suit. I am a doctor practicing in a village,my time and earnings have lost,at 55yrs am stressed out and helpless, kindly advise

As the facts your elder brother is claiming that all the property belongs to him after the death of your father and he has made a partition also from his share to his legal heirs. He himself filed a partition suit claiming shares. As if you do not want to take the case further in regard to the stress and financial issue you are facing. You can approach your brother for a settlement .

if your advocate has filed counter claim with proper grounds you have nothing to worry about. you just keep a track of the case and your evidence and you cross by other side is crucial to the case ,so are the documents. you should be worried only only if you have any apprehension about the way a your advocate is fighting the case.
