Partition suit between my brothers related to my father,s house
10-Aug-2023 (In Property Law)
My father (a sikh) purchased land and build a house G +2 out of his earning . He made a will before his death that this property will be given to my three brothers each floor to one without any share to the 4 sisters . There is a partition suit pending at District Court Delhi. Can i claim (i am one of the daughters) for my share in the property by becoming a party to the partition suit.
Hello maam I have perused your query. If your father has purchased the property out of his earning then the property is self acquired in nature and therefore no son or daughter can claim or is entitled to any share. However if he has made a will for all the sons without including any daughters then he has a right to do so as he is the absolute owner of the said property. Though you can challenge the said will and its authenticity to establish that he died intestate.
