Partition Pressure Of Ancestral Property With No Money In Hand

24-Jan-2023 (In Property Law)
Me with my 3 family members are living in our ancestral property since 1970 which is an joint property with two brothers of my father. Our house is old and now due to leakage it has started leaving plaster from ceiling and it is very poor condition which has to be renovated by any chance. I am 33 yrs old and our first priority is to get the wedding done of mine. But now other two brothers of my father wants this property to be partitioned in three parts which again needs an immediate construction but we do not have ample amount handy to build it and if it demolish it for construction it than needs an extra amt for rent. What needs to be done in this scenario wherein we may stay in the same house for atleast certain time so that we may save some money if we have to reconstruct it in future atleast wedding part gets over within a year or two.

There is a difference between personal problems and legal problems. This seems to be an absolutely personal problem. your house is in dilapidated conditions and it may fall any time soon. you set down your priorities whether to build house first or marriage. my advice to you is, have control on your libido and go for collaboration for construction of property.

Hello, I have perused your query. In these circumstances you need not to construct the property in order to get it partitioned . Simply a partition suit can be instituted in a civil court of law for crystallization of shares and their respective possession. Thereafter, you have an option to sell off your share.
