Partition Act For Land Of Ours
17-Mar-2023 (In Property Law)
History is that we(Christian) bought a land from Ramu (hindu) on 2012 which was Registered on his name like patta and chitta and this land was offered by the govt to his father and he died intestate 1980. So Ramu is the one who was taking care and he sold land to us.. but now 2021 his brother Balu suit a partition case for his share..
1. Will we get the land which we are the owner or do we need give them share.Pls provide suggestions or your thoughts? 2. Will this land comes under ancestral property
You are a genuine purchaser from the seller. The dispute must be taken care of by the seller. If the brother files a case you will be one of the parties to the case. If the case is filed then you try to engage a separate lawyer.
if he died intestate definitely all his legal heirs has shares as per the Christian law. add yourself as innocent third party purchaser in the case and contest it. otherwise it will be hard to get any remedy for you
