Q: Hello, I am facing a legal issue with my 1800 sqft land. I consulted an advocate, but now I suspect

Hello, I had a legal issue with my 1800 sqft land and hired an advocate in January 2019, before COVID. The advocate agreed to take my case and quoted a fee of ₹25,000, which I paid in full. After receiving the payment, he claimed to have filed a petition against the opposing parties. However, he did not respond to my inquiries about the case, and after nearly 12 months, he claimed it was a tough case and he was negotiating with his seniors. When I requested proof of the work done, he refused and threatened me when I asked for a refund of my fees. I am concerned that my advocate is cheating me. What steps can I take to address this issue and file a complaint against him?

Advocate M. Sugan answered
you can give complaint about that advocate for his professional misconduct, before the state Bar Council which is located near High court of that state. There you can get back your money and also punish him for suspension for some period

Q: Tnhb plots buy- resale property

Can I buy the TNHB plot which is allotted in 2002? Is there any time frame that the owner should not sell that property for first few years? What are all the pre checks to be taken before purchasing that plot from second or third owner?

Advocate M. Sugan answered
You must check the allotment paper which has all the terms and conditions. There may be a time limit for sale or restrictions. you must check the allotment letter even if you buy after two/ three transactions. Please go and check with civil lawyer for legal opinion.

if he died intestate definitely all his legal heirs has shares as per the Christian law. add yourself as innocent third party purchaser in the case and contest it. otherwise it will be hard to get any remedy for you

Q: Brother got his share without my approval

we have a house and some vacant land associated with that. This was bought on my mothers name. I have one elder sister (died 20 yrs before who has one son and daughter) and a brother. I am married , My brother without our knowledge got his share ( all service area land) from my mother who is not educated. In that land only, drinking water well, toilet/ washrooms are available. My father died recently and mother is living in that house with my financial support. My brother was not taking care of my father and now not taking care of my mother. Now my brother is trying to sell that land , if it is done, my mother can not live in that house without water/ toilet. Kindly advice me how to stop my brother from selling that land.

Advocate M. Sugan answered
immediately approach the court for injunction for not selling this property by your mother and cancel the settlement deed if any executed by your mother to your brother. since your mother is in that property you don't need to ask recovery of possession if not you must ask recovery of possession also with the injunction suit
