Original third-party GPA not available when selling a site

14-Jun-2023 (In Property Law)
Now I am trying to sell a site that I had bought from an original BDA-allotee about 10 years back. This original BDA-allottee had made a GPA in some other person's name which he had subsequently cancelled. I only have photocopies of this GPA and its cancellation. Are these originals mandatory when I am selling this site to some other person? What are the possible solution to this? I am Hindu

Sir,

Please clarify whether you purchased the question plot through a GPA holder or direct by Original Allotte.

If you purchased through a GPA holder of the original allote, then the GPA is necessary and its cancellation too.

If you purchased the property by original alotee then Such GPA is not required. moreover the said GPA is cancelled and there is no transfer through such GPA to you.

If you have still doubt please apply for Encumbrance.

weather you have got this site registered to your name ? and what is its present value? It appears that all the buyers after a legal opinion want the original GPA. Though the original is not mandatory, since it has some risks involved Banks will not lend to the buyers.
