Original suit case- exparte case(joint ancestral property case)

Joint ancestral property between my father and his brother. He always fight and quarrel whenever we go for mutual partition process. Everyone scared of him in our village. We filed a case recently, he didn’t turn up to court and neither he accepted the summons. Now our advocate asking us to bring two witnesses who must have property around our agricultural land. But thing is no one is ready to give witness because of my fathers brother as everyone scared of him. What is the solution in this case

You file a partition suit against him and produce proper document before the court. If he has not appeared before the court it will posted for exparte. Then give evidence. Once you got preliminary decree apply for final decree for your side of division easily. If you need my advice please contact me.

which is your state and district ? names and addresses of neighbouring land owners as witnesses will not help you in getting Court notices / Summons issued to your uncle. if he is avoiding service of notice us to him file and application in court for Publication in newspapers.
