Obtaining no objection certificate

I Want to transfer the property in name,for which my late husband is the owner.But my children are abroad. Is there any method by which I can obtain no objection certificate from them.Should I send the affidavit from India,to get their signatures or they can use the affidavit from their country.Kindly explain.

As per your query above, No objection certificate is not valid as per the property law.

Your children should execute GPA (power of attorney) in favour of you by assigning the certain powers ( which we will help you out)
then you can execute release deed by them represented by Power of attorney in favour of you.

thereafter you shall be the absolute owner for the said property.

The local authority for change of Khata require affidavits from your children since the local authorities are unaware of their location you can send affidavits to their address and they can resend it to you after signing, which you can submit for change of khatha..

As per your query, your late husban was the owner of the property, after his demise all his legal heirs and his wife gets equal rights in the property, if you want to transfer the property in your name, all your children should have to execute a Registered Release Deed in the Sub Registrar office in favour of your name. Then you can transfer the property in your name and you will be the sole owner of the property. Another way is to ask your children to give Foreign GPA from the particular country's embassy in your name stating the authority to sell/release the property in your name. Then you can transfer the property in your name. The foreign GPA process is bit tricky and confusing, so for that you have to visit the advocate personally to get it done
