Not able to pay back loan took property and not returning blank cheque

My father borrowed some money from a DP Inspector who was known to my father as a friend and in turn mortgaged our home. The money we took was on interest @3% per month and sometime later due to our business loss we were not able to pay the interest - The Policemen pressured us to give him the possession of the house and in turn he will waive off the interest completely. Later, he sold the house charged compound interest - didnt deduct the money we already paid, and is not returning the cheques he took from us while giving the money. Is highly abusive, and misbehaved with my parents.

You should not worry for what happened you simply consult a lawyer for reporting in local police station regarding your cheques and than i suggest you should go for injunction suit or as your lawyer suggests you.

As per Transfer of Property Act the house can not be sold unless and until it was a Mortgage by conditional sale that too your father was to be involved in the sale. Secondly what sought of mortgage your father got involved into there are different mortgages as per transfer of property act.Thirdly a criminal action can be initiated against the Inspector rightaway.Rest documents are to be verified for the same.

in this case you can apply to the court seeking relief, however you will be required to pay the entire amount which you owe to him along with the interest which might duly be mentioned in the contract and agreement which you had with him while taking the money.
