08-Nov-2023 (In Property Law)
We are staying in Palayam, near Andoor. My father purchased 8 Cents around 40 years back, but around place is purchased by other Neighborhood. Now that guys are not allowing to go to our vehicle, even we are rady to purchase the land, but they are not giving. All these day we adjusted, park our vehicle on roda side, but now mother is not well she is unable to walk now, father age is 62 years and mother also 58, he is unable hold her to on the way. We want to go to hospital, it's really very hard to us. So please suggest us.. Is there any way to get the way ..we are ready to purchase the land for way. So please suggest us what to do. Is there any laws, to get the way?
from the query, it is understood that there is a pathway to your property. But the pathway is not motorable. So you could not pay k any vechile at your property. if your neighbour shall provide portion of their property, then you will get motor access to your property. the way left before you is to file a suit claiming that your property is having motorable pathway and your neighbour was encroached in to that. thereby you can claim easement over that property
you can claim easement of necessity in case your property and your neighboring property belongs to one tenement at earlier point of time. otherwise you can claim easement of prescription if you used the way for more than 22 years uninterruptedly and openly and as of right.
