Q: love marriage of daughter without her parents prior knowledge
My daughter, 22 years, loved a guy for years, from her school days and now, before completing her studies, left home and married her lover with the support of her lover's family.Marriage was conducted at a temple for which, we, her parents, were not present. Now my doubt is whether it is necessary to persuade them to undergo procedures stipulated in Special Marriage Act / Hindu Marriage Act for a legal validity and security of my daughter's married life. eventhough it was without our consent. WE, both parties are Hindus. Please mention necessary steps, if any, we have to take, to make her future life trouble free. We want to make it sure that she gets all legal rights as in the case of a mutually agreed and arranged marriage.
Advocate Ranjith V R answered
Marriage between two hindus are legal as long as it has done as per hindu religious rites and customs. The above marriage has to be registered at the local body. Your daughter get all the legal rights of a wife even without registration as long as there are other documents for proof of marriage

We are a joint family. My brothers wife is from kerala and we are from tamilnadu Nilgiris recently my brother and his wife had a fight and she faught with him and returned to her hometown and now she is threatening like she has given a police complaint in Calicut police station and we'd recieve an appearance summon. In this case can I seek the help of the court in my district and prevent my mother from this enquiry. Does law permit that or is mandatory for my mother also to appear in the police station. I want my mother to be avoided from this fake case. What are the possibilities.
Advocate Ranjith V R answered
You can file anticipatory bail before the district court, where you are residing and also file petition before the high Court of Kerala.. it is difficult to avoid mother, in case there are serious allegations against your mother. When they file case you can approach high court for quashing the same. Quashing will depend upon the allegations made against each one.. Thank you

If attachment is already done, then you dont have to worry as you can realise the value of gold ornaments by auctioning husbands property. and also if you know where is your husband keeping your gold ornaments you can take a commissioner from the court and report .
Q: Regarding Maternal grandmother's property
My maternal grandmother died on 2009(abnormal death), without making any will for the property, she inherited from her mother. In 2014 my uncle misguided my mother and her 2 sisters and make them signed in some documents regarding the property (giving full rights to him). At the same time he also misguidedly made my grandfather gave his(grandpa's) self acquired property to his name. In 2017 my uncle died without making any will. After his death, his wife and 2 children (son & daughter) tortured my grandfather many times (not giving enough food and even accused him of fake rape attempt, he has admitted in hospitals many times for food poisoning). (As per my grandfather's will, they only get full rights to the propery after his death, but in this will it didn't mentioned about his maintenance). My grandfather is now in his 80s. Only recently we got to know about all of this. Is there any law regarding the other grandchilds (daughter's childs) can file any case for the above properties?
Advocate Ranjith V R answered
If it is a will your grand father can still cancel it and execute a fresh one. You can also approach maintanace tribunal for senior citzens for getting maintanace. its usually RDO of your locality. You can also approach District legal service authority
