Neighborhood constructed his house in common passage

Hi, I have a partitioned property in chennai, It has common passage of 4 feet width. Neighborhood building pillars constructed in commonpath 1.5 feet occupied and sunshade and balcony fully covered in that passage.The occupied house was constructed in 2005 we partitioned the father property in 2011. In document they are cleary mentioned that Common passage. But front property owner saying you don't have road. Eveytime they are come up with sone issue. It's giving depression to us. Can i raise any legal action on it? Can anyone guide me through like What is the procedure

In this case, file a suit for demolish the property and further you can give a complaint before chennai corporation about encroachment. I have a vast practice in that area you can seek my assistance in your matter.

You need to file a civil case in this regard. The remedy would be to demolish the encroachment portion of your neighbour's house. You can also file a police complaint for encroachment and land grabbing which will be taken up by the landgrabbing cell. Declared common passage cannot be encroached upon by anyone.

you should approach the court and Sikh the demolition of illegal construction and encroachment in your land so first you must if the give show Cause Notice even after the notice they are not obeying then you should approach the Civil Court to demolish the illegal construction
