Neighbor misguiding govt authorities against Court order
06-Jun-2023 (In Property Law)
I have bought a society flat in resale which is allotted to me by Delhi High Court in year 2002. There is a neighbour who is causing problems with the clearance of the flat by misguiding the government institutions like DDA and others by saying the flat is illegal. When the society was constructed, there was a dispute because the builder took money against a few flats that he did not deliver and hence the people lodged a case in High Court and I bought one of these disputed flats. What action can I take against this neighbour who is misguiding against court order.
Dear Sir,
I will have to go through the Order of the Delhi High Court to ascertain the clarity of your title over the said flat.
Kindly be more specific about what "clearance" you are seeking.
Needless to state, if you have a clear title to the said flat, no body can misrepresent any facts to governmental authorities.
Infact, you should approach the DDA (or others) to obtain the necessary clearance(s).
However, if the govt. authorities do not act as per their mandate, you can file a writ petition in the Delhi High Court against DDA(or other government authorities) and seek an adequate relief.
I hope this helps,
Anuj P. Agarwala.

Your concern is getting clearence from DDA. So you need not to do any thing with your neighbour . You should just file a case before court against DDA for giving clearence to your property.
Kind regards

You should file a complaint against the neighbor for mischievous and misrepresentation act and also filed an application for injunctions against him for his wrongful act for the purpose of his wrongful gain
