Need legal advice to claim house gifted to brother by mother.
23-Oct-2024 (In Property Law)
My brother persuaded my mother to transfer the current house in the form of gifting deed. I am currently not residing with them as i am located to a different city for work. I feel cheated because my share has not been given to me. My mother and brother promised to pay me whatever my share will be. now my brother is refusing to pay anything. What is my legal option? how can i claim the house now? the papers have been already signed.
whether you will get your share in the house property depends upon whether legally you have a right in that properly. That depends upon the source from which your mother got that property, if she had got it from her mother or father then you have no legal right even though you feel cheated.
First, it is important to clarify whether the property in question is ancestral or self-acquired. This distinction will influence the legal rights and procedures involved. Additionally, please confirm in whose name the deed is registered and whether your mother has gifted the property to your brother through a legal gift deed. These details are essential to understand the legal standing of the property transfer and to determine the next steps. Once you provide this information, I will be able to guide you properly and suggest the best course of action to protect your rights.
