Need legal advice on Seperation of 2 brothers staying together.

17-Jan-2023 (In Property Law)
Myself and my brother stay together at one place. Our parents are no more with us and by brother is completely non cooperative. He is a violent and a drunkard person. He does not have any family and is divorced due to his bad nature and behaviour. He does not have any job for the last 5 years and is jobless. He is completely dependent on me for all his basic necessities. Due to his fighting and disruptive nature me and my family no longer want to stay with him. We have talked to him many times to get separated amicably and agree to provide his share on the property but he has always rejected this proposal. He forcibly wants to stay with us and we are fed up of his behaviour. Please advice what can be done in this case as we can’t tolerate such a person in our house anymore and he can’t force us to stay together. Kindly provide a solution to this problem.

Hi,
Since the matter can not be resolved amicably between you and your brother it would be prudent for you to have a parition of the property. Do share better particulars as to the title of the property

There is a violent behavior towards one and all in the family including ladies. This is a case of sheer domestic violence. You need to file one against the erratic. A simultaneous case of partition of property involved is also needs to be filed. This is your only solution to problem alleged herein.
