My wife has ancestor property. My wife has three brothers, one died

My wife has three brothers in which one died last year. Her mother is no more and father is 86 and on bed. Her father living in Grand father house. Can my wife ask for her share now? because we are already 59 years of age and are grand father and mother. Her father is not transfering anything. Can we demand for my wife and our children?

hello clients as i can see your issue is really very much serious as well as you are also been deprived of your rights as childreans yes you should fight fir this matter for aure as well as you will alao get your share.

Since the property belongs to her grand parents, and it’s jointly occupied till date, we assume it as HUF. However if the property has been acquired by her father from her grandfather it will be treated as self acquired property of her father. In both cases the legal recourse is different.
