My son's right on property of my husband's mother
27-Feb-2023 (In Property Law)
I got married(arrange marriage) in 2010 but it was like a fraud marriage bcoz I got to know about all bad habits(regular drinking, smoking, abuse by bad words, beating) of my husband in first month after marriage.I gave birth to a baby boy in 2011 & file a divorce case in 2013(without demanding any alumni or single penny from in-laws) but in 2015 he took us back with him with help of written conditions in judges mediation but all in vain because he is still same & now I am back again to my mother & preparing for divorce again..I just want to know if my son has any right on his grandmother's property because as per my knowledge(not sure) she has earned all 3 properties by her income from govrnement teaching job. Also please tell me if I have any right on the gold got from in-laws.
Gold and all other gifts given to you by either side is you property no one else has any right over them but however self acquired property of your mother in law belongs to her and will go to whoever she makes a will.If she does die without a will then only you and your son will have entitlement to a share in the property
Hello M/s -------------------- Your son can ask his rights in his grandmother's property but if she is alive it is her wishes if she wants to give or not .... there are so many things which can't be discussed here, for details you can call me or meet me.
You are entitled to maintenance and divorce from him based on various provisions. Since when did you start living separately.
Your son is also entitled to his share in the ancestral property of the grandmother. You have a right only in the gold bought frm your own money or your parents and not given as gift on your wedding by your in-laws.For a detailed advise, please contact us with full details so that we can help you more effectively.
