My name is Arbaz, I asked this question that how many years does it take to file a civil suit to encroach on any land or to get the rights on the land? What is the limitation period for filing the case?
as per article 65 of Limitation Act its 12 years, when you have proper title of the land. It means 12 years from the day title became adverse, hostile to you. Further you need to prove ownership for land only revenue records are not sufficient but requires other document of transfer of title.
You may file a suite for declaration for rights acquired on the basis of adverse possession after 12 years (against private owner) or 30 years (against government property)from the date of such acquisition or from the date when you denied the rights of the orignal owner or demonstrated hostile intent towards the owner.
