Free site given by govt wen my father alive but now this site is in name of my mother...we r 4 daughters.....am one of it my mom stay with my divorcee sister....and was living since 3 years my mothers home since she was in Dubai...w she is asking me nd my husband nd children to vacate the house...and wanted to live with my divorced sis...my condition is very bad to go rented house..askin her permission to construct on the top floor a small room...but she is not allowing and telling me it's my own house u have no right...what is the right of
Dear Madam,
Since the property belongs to your father, it is certainly not the exclusive property of your sister and hence she can't claim absolute right over the same. Since you, your mother and other sisters have joint rights over the same, the same is subject to partition. Considering the same i would advice you to file a suit for partition with respect to your share and at the time of filing the case, you have to file an application seeking stay against other members from dispossessing you and your family until the case is completed.
