My Father own earned property, and he passed without settle legal hires. We 5 ( mother, elder brother, elder sister, and younger brother ) having an issue to settle ourselves. My brothers are currently staying on the property, and my younger brother has stolen property documents without my mother's knowledge, also ill-treated her and my elder brother. The property is 3600 sqft of plot and worth ~4C. Any suggestion on dividing ourselves without issues, and we want our mother life should be remaining peace lifetime.
You can very well file a suit for partition in which the court will decide about the share of each legal heir. You need to apply for certified copy of documents at the sub-registrar office. The original documents in the custody of your brother may be dealt with in the suit proceedings.

yes if your father have died intestate then you all legal heir have equal share, yes you can easily apply for settlement or a partition if one of you doesn't agree the terms and conditions since your father have not written any will or settled on you legal heirs
