My father and my uncle own a joint DDA flat in Delhi. My father expired last month. Now my father's sister has a will and she says she has the ownership of my father's share of property. Does my mother has any rights on the property and how can we get a solution to this legal issue. We have the Conveyance Deed of DDA having my father's name and my Uncle's name. The electricity and water Bills come in my aunt's name. Please advise.
In order to get share through any Will, it is mandatory to get the Will probated before the Court as per law. You and your mother can challenge the said will and surely get the share of your father in the said property. Nowadays many fabricated and forged Will comes into picture to usurp the property, however you and your mother being the legal heirs of your father can challenge the same and get your property.
