Mother share in father's property jointly owned by them

09-Oct-2023 (In Property Law)
My mother and father own a house jointly 50-50, with my mother being the 1st owner. They have been living away from each other for 16yrs but are not legally divorced. Now my mom wants her share of the property to reinvest but my father doesn’t want to sell or buy her out. What is the legal solution to this. The house was purchased much after their marriage and separation. They are both Hindus.

Dear sir, you can request your father to execute Gift Deed or Release Deed in favor of your mother. Kindly contact us to know more details about the way of execution of Release Deed or Gift Deed in legal manner.

In respect of land it is possible to define seperate share by procedure. But in case of house it is difficult to divide half part of the house if it is one story building. Tell your father either purchase her half part or sell out the whole property.
