Misuse of the original agreement without date by the buyer
27-Aug-2023 (In Property Law)
I recently sold my house. On the date of sale deed, buyer and I signed another agreement on which it was mentioned that seller is giving physical possession of the house on as is and where is basis. It was a short agreement that my lawyer suggested to keep as proof that I had handed over the possession of the house to the buyer. It was signed by both parties and 2 witnesses. But before I could write the date on it, the buyer took it away. Later he gave me a photocopy of it which didn't have the date. He put the date on top of the photocopy in blue pen and also signed in blue pen in the centre in order to self attest it. I was shifting my home and in a rush didn't notice that the buyer had not put any date on the original and just put a date on the photocopy. Now he has possession of the original agreement with no date on it. My concern is that later on he can misuse it by putting another date on it. Can his claim be contested based on the photocopy that i have?
Ask for the original document and attach an affidavit to it attested by gazetted officer with the signatures of both the parties with effect to the date. Do this before the consequences even arise, so that no such claim can be entertained. Get a photocopy of the edited document and keep it for future purposes.
If the buyer has done such a fraud you can immediately get a complaint registered against him .and have you received the payment for the same or not??If no payment has been made you can seek the cancellation of documents as well. Please contact for further details thanks.
