Mental Harassment by sister over property causing mental trauma

06-Oct-2023 (In Property Law)
Good morning. (Hindu family) I would need your guidance on an issue my mother and her other sisters are facing by one particular youngest sister over a property (bunglow) which was sold 2 months ago. My mother has 5 sisters, meaning 6 in total. 1st issue :The younger sister is not sharing the amount she has received unfortunately separately while the house was being sold. There were 5 seperate cheques issued and my mother was living in a separate state she didn't receive a cheque on her name, however mutually my other aunts are giving my mother her share but the youngest aunt is adomant. 2nd issue: My youngest aunt is also terribly mentally harassing all the other aunts in the family especially my eldest aunt, which is causing her visibly physical and mental trauma. Please guide me what can my mother and other sisters do against her to stop this horrible harassment? Will appreciate your help highly on this matter! Thank you, Kind Regards Kaneeca New Delhi

Greetings!

I read your notes and found that there are some queries which have come to my mind. They are:

1. In whose name the property existed
2. If an NOC from other co-share holders where ever taken
3. If the property was registered

I'm based in Delhi and if you are willing we can discuss it off-line.

Sometimes consultations over the internet without proper scrutiny of the documents and facts may result in bad understanding of the case in hand, followed by poor advice.

Please feel free to contact me.

The documents will have to be seen in order to advise appropriately. However, there may be a possibility of filing both a suit for partition and a suit for recovery of money. Both the issues raised are connected with each other.

Kindly share more details about the ownership of the property alternatively you can come to our office for free consultation as first we need to examine the documents which are connected with the transaction.
