My father in law send a legal notice to vacant his house within 15 days.as per dayabhanga bangs law my wife claim his father's property.i am hindu
Yes. Your wife can claim her father's property but she can claim after the death of her father. Before death, he is the absolute owner owner of his property. He can transfer (sell, gift, lease etc) it to any third party. so now your wife cannot claim her share.
Without examining of papers it is very difficult to come a conclusion that how and under which act you have a right to claim your share in the property. Apparently it appears that you have the right but unless the same is being discussed it is not possible to frame any views in the matter.
Right to father's wholly owned property can not claimed or grabbed during his life time by his son or daughter ,if not specifically gifted or sold to such son or daughter or both by him through lawful manner. Such property , In absence of any will made by him during his life time, spouse and other legal heirs shall be Coparcener.Your wife has no legal stake to the referred property at this stage.
