Married daughter is liable for property of died father

My father has died my brother is mentally challenged n staying with my ChaCha now my ChaCha is looking after all the property matters of my father he wanted to sell my father's flat without my permission n my father he has not registered any will with any one so......I can take an action on my uncle please suggest
yes you can definitely take action against your uncle property of the father is your property in succession if your brother is mentally challenged then you can file letters of Administration where you will be appointed as an administrator in which you can claim 50% of the property and for the 50% of your brother you can create a trust and be a trustee of the same till you are alive .
