I m looking for a property. I just wanted to know that What Legal paper work I should undergo before purchasing a property to avoid claims of property share from seller family. Because I have doubt that seller is hiding some legal heir.
You are right and it is the responsibility of the buyer to check whether the seller has got the real title over the property . Please call for the parent document by virtue of which he got the title over the property.

First of all get Encumbrance certificate of property, in encumbrance certificate you will know any registered liability on the property. Verify tiltle deed and parent deed. Get computerized patta of the property ,from this you will know present title of property. If you check the above papers you will be able to find anyone have claim on the property.

Usually, the title to the property has to be traced back for 30 years. ask the vendor to produce all the parent documents dating back to 30 years. Check the encumbrance certificate also for the relevant period. Make discreet local enquiries to your satisfaction.

Dear sir, without reviewing the documents advocates wont advice you, entire set of title documents encumbrance certificates death and legal heir certificates and others documents will be required at the time of title review
