Legal Remedies for Non-Compliance of Consent Terms

13-May-2025 (In Property Law)
I am seeking legal advice regarding a matter where the Plaintiff (opposing party) has failed to comply with the Consent Terms that were mutually agreed upon, duly signed by both parties, and accepted by the court. As per the Consent Terms, I had agreed to surrender my 50% share in a property in exchange for a mutually decided amount. However, despite the clear obligations outlined in the agreement, there has been no action or payment from the Plaintiff’s side. I would appreciate your guidance

If the Plaintiff has failed to abide by the consent terms executed before the Court then you must go for execution of the same. For that you need to file execution proceedings. Feel free to contact me for seeking any legal advice as regards the same.

Well, if the Plaintiff has failed to comply with the Consent terms executed between you and him before the Court, then, you can sue him for the Breach of Consent Terms and seek Specific Performance of Contract under the Specific Relief Act, 1963.

Well, it is clear cut, that, the Plaintiff has broken the signed Consent terms which is equivalent to Breach of Contract, for which, you can either seek monetary compensation or seek Specific Performance of Contract/Consent Terms, from the party which has broken the Consent Terms!
