Legal Help Needed: Missing Link in Land Title & Mutation Issue

05-Jun-2025 (In Property Law)
I need legal advice regarding a land in Kasbe Solapur. Though the land has changed hands from Paralkar → Salunkhe → Babaladi → us, the 7/12 still shows Paralkar’s name. We have sale deeds for the last two transactions, but no document for the first (Paralkar to Salunkhe). Due to this, mutation is not possible. Please advise how to complete the title chain and update 7/12. Can affidavits or a declaration help? What legal steps are needed?

You can obtain the certified copy of the missing Deed of conveyance from the Sub registration office. Accordingly you can ask the authority to enter the name of the previous owners and their after you can ask the concerned authority to enter your name as per Bechain of agreements. even after providing the documents if the concerned authority is not entering the detail you need to file a declaration suit against the and send authority directing them to complete their records by completing the chain of agreement.

Updating land records when supporting documents are missing can be done through a combination of online and offline procedures, including visiting the relevant Tehsil/Circle Office, submitting an application with necessary details, and potentially filing a Right to Information (RTI) request. If original documents are lost, obtaining duplicate copies or affidavits may be required.

To complete the title chain and update the 7/12 extract for your land in Kasbe Solapur, the missing link in ownership (Paralkar to Salunkhe) is the core issue preventing mutation. Since you have sale deeds for the later transactions but no registered document for the first transfer, the title chain is incomplete in government records. In such cases, the following legal steps are advisable: Affidavit and Declaration: Salunkhe (or their legal heirs, if deceased) can execute an affidavit-cum-declaration stating that they acquired the land from Paralkar and confirming possession and ownership, along with supporting evidence like possession receipts, tax payments, etc. Notarisation: Get the affidavit notarised and attach it with the existing sale deeds. Indemnity Bond: Submit an indemnity bond indemnifying the government against any future claims due to the missing document. Mutation Application: File a mutation application with the Talathi or Tehsildar, enclosing: All sale deeds Affidavit and indemnity Tax receipts and identity/address proofs If mutation is still denied, you may need to file a civil suit for declaration of title to regularise ownership through a court decree.
