Lease transfer of DDA shop in case of death of the lessee

My father in law & his friend purchased a shop on lease in naya bazar delhi from dda. My father in law is no more.all four legel hiers and uncle (papa's friend) agree to release their 100% share to my husband's name.what is the process of tranferring of lease when there is no will? After that is it possible to make it freehold? (We r hindu)

yes it is possible. get relinquishment deeds from all the legal heirs/concerned persons and then make an application to the DDA to transfer the lease in your husbands name. just to be safe, you should also file a suit for declaration and make all the legal heirs parties and have their statement recorded before the court that they are relinquishing their share in your husbands favour. this court order will have greater efficacy. after that you can apply to the DDA and have it converted to freehold as well.

In the given case, a deed needs to be drafted wherein it shall be stated that all the remaining legal heirs have transferred their right to your husband. Besides this, all the legal heirs shall file affidavits stating the same.

The deed based on which the shop was originally leased from the DDA also needs to be looked at in order to find any given procedures which may have been established in order to deal with situations, such as the current one.
