Joint name bank locker dispute - Mother/ Daughter

19-Jan-2023 (In Property Law)
My mother and sister have a bank locker in joint name where they have kept their jewellery. My sister only used to operate this locker. My sister expired and the bank locker keys are with her husband. We have requested him many times to come to bank with us and resolve this however he is always ignoring us. My mother has worked very hard to make little jewellry for herself and now she is completely devastated by my sister's death. As per bank, keys and heir of deceased is required to close the account. Kindly suggest what can be done.

First of all you have to clear that whether entire jewellery is purchased by your mother or sister. If it is jointly owned then you need to take hair ship certificate from court. Or if both parties come together mutually can pen the same.

Your mother has to write a letter to the bank requesting the bank to let her close the account as even she’s a joint owner in the account.
If the bank does not let your mother withdraw the valuables from the bank then you may proceed to again write to the bank asking the bank to require your sisters husband to visit the bank for withdrawing the jewellery.

Hello there! If a person is not ready and willing to perform his obligation we can send him legal notice and ask him to co-operate and comply the procedure required to be followed by bank.

This may help you to get your ornaments asap.
