Your query is not clear, kindly tell us that weather that property belongs to your mother or is in the name of father and is on you brother name.

You have not clarified that the property concerned is ancestral or self owned property of your father or is there any will by your father.
If no will, the property is joint & your mother, you & your brother are joint owners and your brother cannot harass you like this.
You can file injunction suit or partition case against your brother or if you all are agree, property can be sold and money can be divided into 3 shares, subject to proper scrutiny of documents..
