Is it necessary to enter eloped sister name in khata transfer
14-Aug-2023 (In Property Law)
My sister has eloped 7 years back and is it necessary to mention her name in family tree and affidavit for transfer of khata as my father has expired and i want to transfer it to my name ,as we are not aware of her whereabouts. What should we do?
Though law presumes 7 years non traceable of a person is presumed as dead. You can publish one paper publication about her missing and even lodge complaint also , if you have done so you can keep those documents with you as proof to face further complications in future. If your mother is alive means the khatha of your father has to be changed in her name and not in yours. Reach out the jurisdictional BBMP office to know the procedure and consult advocate.
Who r u? Whether son or daughter? Whether your mother is alive? Have u given missing complaint against your sister? Without these details i am unable to give u proper instructions.
Can get death certificate by eloped person name if it's finished more then 7years,but it's not a matter in Hindu succession act if there is a person dead or eloped whatever should be enter in family tree.
