Inquiry About Legal Action for Property Dispute with Brother

"My mother signed a registered copy at the registered office stating that she took some money and had no objection to giving property to her brother. However, her brother did not give her that money and is saying, 'Do whatever you want; I won't give a single rupee.' With relatives, he is claiming that he gave her the money, but he hasn't given her anything. Can she file a case for an equal share?"

It seems that she signed a release deed of the family property stating that she recieved consideration due to which is giving up/transferring right in that property. Now with the help of witnesses she can file for its cancellation stating that she has not received any consideration

yes she can file a suit for partition and seperate possession and also for the relief that through deceit he got the relinquishment deed and hence the same be held as null and void and also ask for mense profits. you have to mention in detail about how he by deceit or cheating got executed the registered deed.

is it a self earned property or ancestral property? if it's a self earned property of he mother, her daughter will not get anything. but in case, if it's a ancestral property, she can file a case for her share. need more info, for clarity.

Once a document is signed it is considered as the amount has been taken, in fact to get the money from her brother, she can still send a legal notice to her brother and then take legal action further.
