Inherited Property from Father - Can i sell it

My parents were legally separated 24 years ago. At that time my elder brother went with my mother and I stayed with my Father as per our will and the decision of the Honb. High Court. 7 years ago from now my father purchased an apartment. Now he has died 4 years back. In a situation like that, can I alone sell that property or I have to take NOC from my brother / succession certificate.

you have to find out first that at the time of divorce degree the legal custody was given or not if given then your elder brother has no right on this property and is this was property bought before the divorce degree

In case of immovable property, Succession Certificate has no applicability. It is necessary to know whether there is any Will of your father or not and whether your mother is remarried or not.
