Inherited property development
05-Jan-2023 (In Property Law)
My Father has a house in Chennai and he passed away. He has Son(me) and my sister as legal heirs. Now we want to demolish the house and build 2 apartments ,one for each of us. Kindly let us know what process we should do to make each one of us owner of single apartment and equal share of land.
What about your mother? She's a legal heir as well. Using death certificate and legal heirship certificate you can include the names legal heirs in the place of your father's name in revenue records. Now, after the change, you can take steps for development of the property with an agreement detailing financial contribution of each legal heir, sharing conditions, etc.
you can make a partition deed divided the land equally built an apartment and each one want to take one one flat then you make what is the Builder pyria and according to the build-up Maria you make the proportionate share if both build up area of a share then they make a proportionate share of share you dear Zindagi land that may be equal if it is 1200 square feet flat flat the use of both will became 600 square feet if you are building more than three Apartment then according to the apartment building area the proportionate share will be fixed
