Independent house construction issue

My father inherited whole house from my grandfather (their self acquired) through registered will and later my father gifted few room on first floor only to my uncle. Now my father wants to construct on second floor but they are not allowing it and not giving NOC. If my father gifted only portion on first floor and he has every right to construct on second floor as mentioned on will before giving gift deed, what can be done if my uncle is not allowing for construction/NOC?

You can file Declaration and permanent injunction Civil Suit in civil court in whose jurisdiction property is situated against your uncle. Therefore you can preliminary send legal notice through lawyer to your uncle.
